TERMS OF SERVICE & STUDIO POLICIES

Selah Studio is a registered DBA of The Cross Fitness, LLC, a California limited liability company (“Selah Studio,” “we,” “us,” or “our”).
By creating an account, purchasing services, booking classes, or participating in any services offered, you agree to these Terms of Service.
1. Eligibility
Participants must be at least eighteen (18) years of age.
By creating an account, booking services, or participating in any services, you represent and warrant that you are at least eighteen (18) years old.
Selah Studio reserves the right to request proof of age at any time.
2. Health & Medical Acknowledgment
Participation in Pilates reformer and group fitness classes involves physical exertion and inherent risks.
By participating, you represent that:
You are physically capable of engaging in exercise activities;
You have consulted a physician if you have any medical condition that may affect participation;
You will inform instructors prior to class of any injuries, limitations, medical conditions, or pregnancy.
Instructors provide general instruction, demonstration, and guidance. You remain solely responsible for monitoring your own physical condition and determining whether to participate, modify, or discontinue any activity.
You acknowledge that participation may result in physical injury, including serious injury or death.
Selah Studio does not provide medical advice, diagnosis, or treatment.
3. Assumption of Risk
You voluntarily assume all risks associated with participation and use of equipment, including but not limited to:
Falls;
Equipment malfunction;
Muscle strains or sprains;
Serious bodily injury.
Participation is undertaken at your own risk.
4. Release of Liability
To the fullest extent permitted by California law, you release and hold harmless The Cross Fitness, LLC dba Selah Studio, its members, owners, employees, contractors, instructors, agents, and representatives from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to participation in services or use of facilities, including claims arising from ordinary negligence.
This release does not apply to claims arising from gross negligence or willful misconduct.
5. Limitation of Liability
To the fullest extent permitted by California law, Selah Studio’s total liability for any claim arising out of or relating to participation in services, use of facilities, or these Terms shall not exceed the total amount paid by the participant to Selah Studio in the three (3) months preceding the event giving rise to the claim.
Under no circumstances shall Selah Studio be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, or emotional distress.
6. Booking, Cancellations & No-Shows
All classes must be reserved in advance through the designated booking platform.
Cancellations must be made at least nine (9) hours prior to class start time.
Failure to cancel within the required window constitutes acceptance of the late cancellation policy and associated fees and will result in:
Loss of class credit for any reserved class, and/or
A $15 late cancellation fee, where applicable.
Failure to attend a reserved class without cancellation (“no-show”) may result in a $20 no-show fee.
All fees and policies are subject to modification with notice.
7. Payments, Memberships & Refunds
All purchases, including but not limited to memberships, class packages, single classes, workshops, events, and retail items, are non-refundable and non-transferable unless otherwise required by law.
Membership terms, billing cycles, expiration dates, and usage limitations are disclosed at the time of purchase.
Selah Studio reserves the right to suspend or revoke access to services for violation of these Terms.
Failed Payments & Suspension
A valid payment method must be maintained on file for all active memberships. If a scheduled payment fails, the membership will be temporarily suspended and booking privileges revoked until payment is resolved. If payment is not successfully processed within seven (7) days, the membership will be automatically canceled. Members remain responsible for any outstanding balances. Reactivation of a canceled membership may require purchase of a new membership at current rates.
Chargebacks & Payment Disputes
If a member initiates a chargeback or payment dispute for services rendered, Selah Studio reserves the right to immediately suspend or terminate access to all services pending resolution of the dispute.
Members remain responsible for any valid charges incurred. Selah Studio reserves the right to recover fees, costs, and administrative expenses associated with resolving payment disputes to the extent permitted by law.
8. Studio Conduct & Safety
To maintain a safe and welcoming environment, clients agree to:
Follow instructor guidance;
Use equipment only as instructed;
Place personal belongings in designated cubbies or storage areas;
Keep walkways and workout areas clear of personal items.
Selah Studio is not responsible for lost, stolen, or misplaced personal belongings.
Unsafe, disruptive, or inappropriate conduct may result in removal from class without refund. Selah Studio reserves the right to refuse service to any individual whose behavior compromises safety or community standards.
9. Retail & Merchandise
All retail sales are final unless an item is defective. Defective items must be reported within seven (7) days of purchase.
10. Special Events & Workshops
Special events or workshops may have separate policies. No refunds are guaranteed unless expressly stated.
11. Photography & Media Consent
By entering the studio, you acknowledge that photography or video recording may occur for promotional or marketing purposes. Media may be used in print, digital, or social media marketing.
Consent is granted without compensation.
If you prefer not to be included, you must notify Selah Studio staff in writing.
12. Intellectual Property
All branding, logos, materials, and content are the property of The Cross Fitness, LLC and may not be reproduced without written consent.
13. Arbitration & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California.
Any dispute, claim, or controversy arising out of or relating to these Terms or participation in services shall be resolved through binding arbitration administered in San Diego County, California, in accordance with the applicable rules of the American Arbitration Association (AAA) or a comparable arbitration provider.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration provision.
Each party shall bear its own attorneys’ fees and costs, unless otherwise required by law or awarded by the arbitrator.
By agreeing to these Terms, you knowingly and voluntarily waive the right to a jury trial and waive participation in any class-action proceeding.
14. Severability
If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.
15. Modifications
Selah Studio reserves the right to modify or update these Terms at any time in its sole discretion. Updated Terms will be posted on the studio website or booking platform with a revised effective date.

WAIVER & RELEASE OF LIABILITY
PRE-PARTICIPATION WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
Participation in physical exercise and use of exercise equipment involves inherent risks. By signing this agreement, you acknowledge and agree to the following:
1. Voluntary Participation
I voluntarily choose to participate in Pilates reformer classes, group fitness classes, strength training, stretching, mobility work, workshops, and related activities offered by The Cross Fitness, LLC dba Selah Studio (“Selah Studio”). I understand participation is voluntary and that I may discontinue at any time.
2. Assumption of Risk
I understand that participation in physical exercise involves inherent risks, including but not limited to: muscle strains and sprains; ligament or joint injuries; falls from or around equipment; equipment malfunction or misuse; injuries caused by other participants; slips, trips, or falls on studio premises; serious bodily injury; permanent disability; or death. I understand that Pilates reformer equipment contains moving parts, springs, straps, cables, and elevated platforms that require attention and proper use. I acknowledge that risks may arise from my own actions, the actions of other participants, instructor instruction, studio conditions, or equipment. I knowingly and voluntarily assume all risks, both known and unknown.
3. Release & Waiver of Liability
To the fullest extent permitted by California law, I hereby release, waive, discharge, and hold harmless The Cross Fitness, LLC dba Selah Studio, its members, owners, employees, instructors, contractors, agents, and representatives from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or related to my participation in services or use of facilities. This release includes claims based on ordinary negligence. This release does not apply to claims arising from gross negligence or willful misconduct.
4. Waiver of California Civil Code §1542
I understand that this release extends to claims that I do not know or suspect to exist in my favor at the time of signing. I expressly waive the protections of California Civil Code Section 1542, which states: “A general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected their decision.”
5. Health Acknowledgment
I affirm that I am physically capable of participating in exercise activities. I understand instructors provide general instruction and guidance. I remain solely responsible for monitoring my condition and determining whether to participate, modify, or discontinue any activity. I agree to stop exercising and notify an instructor if I experience pain, dizziness, shortness of breath, or discomfort. I understand Selah Studio does not provide medical advice, diagnosis, or treatment.
6. Emergency Medical Authorization
In the event of illness or injury, I authorize Selah Studio to seek emergency medical care on my behalf. I understand I am solely responsible for any medical costs incurred.
7. Indemnification
I agree to indemnify and hold harmless Selah Studio from any claims, liabilities, damages, or expenses arising from my participation, misuse of equipment, or violation of studio rules.
8. Personal Property
Selah Studio is not responsible for lost, stolen, or damaged personal belongings.
9. Severability
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
10. Digital Acknowledgment
By selecting “I Agree” below, I acknowledge that I have read this Pre-Participation Waiver, Release of Liability & Assumption of Risk Agreement in its entirety. I understand that by agreeing, I am giving up certain legal rights, including the right to sue for claims based on ordinary negligence. I agree voluntarily and without coercion.
